Heidelberg - A seminar, hosted by Forum Institut, one of the leading seminar providers in Germany, is tailored to non-U.S. trademark practitioners and will provide in-depth information and advice on highly relevant, challenging areas of U.S. trademark law. The course will offer tips on how to avoid mistakes foreign trademark owners commonly make in U.S. trademark prosecution practice, including how to efficiently use the Madrid Protocol when designating the U.S. A discussion of the newest "Fraud" case law will offer recommendations on how to avoid a finding of fraud and the cancellation of the U.S. registration. An overview of U.S. trademark litigation will explain nuances and quirks in U.S. practice, including a discussion of discovery, privileges, experts and jury trials. The course will highlight areas in which U.S. trademark law significantly differs from European law, including how the new federal dilution law (TDRA) protects well-known marks in the U.S. In addition, this course will discuss "use in commerce", which is necessary for obtain.
